Discussion/approval/disapproval of Resolution No. 052825-RD24-153 accepting Right-of-Way No.16-121498-00 from Arizona State Land Department for the purpose of locating, constructing, operating, and maintaining a public road, also known as Peralta Road, located in Sections 1, 5, 6, 10, 11, 12, 15, 31, 32, and 36; Townships 1S and 2S; Ranges 9E and 10E. (7)AG. Discussion/approval/disapproval to accept the award amendment for the AmeriCorps Program between the Arizona Supreme Court Administrative Office of the Courts and Pinal County through the Pinal County Board of Supervisors. The amendment decreases the award total to $15,211. The Adult Probation Office will use the award to pay the volunteers that are assigned to the AmeriCorps Program. Acceptance requires a budget amendment to align the FY24/25 budget to the award amount and transfers reserve appropriation from Fund 221 (Adult Prob/GPS) to Fund 213 (Grants/Project Contingency). There is no impact on the General Fund. (John Fuery)
(8) Call to the Public— A "call to the public" is the time period for members of the public to address the Board of Supervisors to provide public input relating to subject matter within the Board of Supervisors authority or jurisdiction. Those wishing to address the Board of Supervisors need not request permission in advance. Action taken as a result of public comment will be limited to directing staff to study the matter or rescheduling it for further consideration and decision at a later date.
(9) Discussion/approval/disapproval of Resolution 052825-AQ to remove the emergency affirmative defense provisions in Chapter 3, Article 1, Section 081 (§3-1-081) and the affirmative defense definition in Chapter 8, Article 1, Section 020 (§8-1-020) of the Pinal County Air Quality Control District Code of Regulations. Rulemaking action required by the U.S. Environmental Protection Agency (EPA). The provisions in Pinal County Code established an affirmative defense that industry could have asserted in enforcement cases brought for noncompliance with technology-based emission limitations in operating permits, provided that the exceedances occurred due to qualifying emergency circumstances. These provisions, which have never been required elements of state operating permit programs, are being removed because they are inconsistent with the EPA’s interpretation of the enforcement structure of the Clean Air Act. In practice, the EPA has found no examples of these defenses being used, and Pinal County Air Quality Control District (PCAQCD) also has no record of them being used in Pinal County. 30-day public comment period ended with two stakeholders present at oral/hearing proceeding; No questions or comments received on this rulemaking during public comment period.
