13. Executive Session pursuant to ARS 38-431.03 (A)(3)(4) for legal advice in order to consider the county's position and instruct Snell & Wilmer, county's appointed conflict counsel for this matter, regarding the legality of the agreement and the scope and functions authorized or delegated to the County Attorney's Office in a Memorandum of Agreement, 287(g) Task Force Model, dated August 28, 2025, executed by the County Attorney and Department of Homeland Security, US Immigration & Customs Enforcement without prior Board authorization, and if such Board authorization is required. The County Attorney's Office has agreed that a conflict exists which necessitated the retaining of conflict counsel by the Board of Supervisors. Call to the Public— A "call to the public" is the time period for members of the public to address the Board of Supervisors to provide public input relating to subject matter within the Board of Supervisors authority or jurisdiction. Those wishing to address the Board of Supervisors need not request permission in advance. Action taken as a result of public comment will be limited to directing staff to study the matter or rescheduling it for further consideration and decision at a later date.

Arizona Farms Road and Apollo Drive in unincorporated Pinal County, AZ. The Planning Commission recommended approval (8-1) of case SUP-016-25 with one (1) stipulation. Supervisor District #4. Public Hearing and discussion/approval/disapproval of Resolution No. 2026-SUP-010-25, a Resolution approving case SUP-010-25; Tim Ferrara, owner, and Bill Koning, New Cingular Wireless PCS LLC, applicant, are requesting approval of a Special Use Permit to operate a new wireless communication facility (WCF), on a 6.32± acre parcel in the Suburban Ranch Zone; Tax Parcel: 210-73-0030 (legals on file); situated in a portion of Section 27, Township 03 South, Range 08 East, generally located northeast of East Copper Mine Rd. and N. Main St., within incorporated Town of San Tan Valley, in Pinal County, AZ. The Planning and Zoning Commission recommended approval (8-0) of case SUP-010-25 with fourteen (14) stipulations. 12. Public Hearing and discussion/approval/disapproval of Ordinance No. 2026-PZ-019-03, an Ordinance approving case PZ-019-03 with one (1) stipulation. The Pinal County Development Services Department, with the consent of the property owner, is requesting the Board to consider its options under A.R.S. § 11-814(I), which provides that the Board may "grant an extension, determine compliance with the schedule for development or cause the property to revert to its former zoning classification." In 2003 the property was rezoned by a former owner from Single Residence Zone (CR-3) to General Business Zone (CB-2), conditioned on a schedule of development for expansion of a daycare facility under stipulation #7 of the 2003 rezoning, and pursuant to A.R.S. § 11-814(I). The daycare center expansion never occurred. Now, the current property owner desires the Board to cause the property, upon which an existing single family residence is located, to revert to its former zoning classification of Single Residence Zone (CR-3) because the property owner desires to improve and continue use of the single family residence on the property for residential purposes. The subject property is a ±0.37 acre parcel situated on a portion of Section 09, Township 01 South, Range 09 East of the Gila and Salt River Base and Meridian (legal on file), tax parcel 104-38-027A, generally located east of the intersection of E.
